Terms & Conditions

2. Acceptance of Terms

By submitting an enquiry through our website, by booking a Service, or by attending a Session, you confirm that you have read and agree to these Terms and Conditions in their entirety.

Our Services are available to persons aged 18 and over. By engaging with us, you confirm that you are 18 or older, or that you are arranging a Service on behalf of an eligible family member and have the authority to do so.

3. Description of Services

Vesta Council provides three administrative and educational services described in detail on our website at solutions page. All services are administrative or educational in character. We do not provide legal advice, financial advice, medical advice, or any regulated professional service. Any question requiring such advice will be directed to an appropriate professional outside of our services.

Services are delivered in English. Limited bilingual assistance (English/Thai) may be available upon specific arrangement and is not part of the standard service scope.

4. Service Scope and Limitations

Personal Records Indexing

Covers sorting, labelling, optional scanning to the participant's own device, and the production of a written index. It does not include interpretation of document content, legal advice, financial analysis, or retention of document data by Vesta Council.

Retirement Vocabulary Course

Covers four sessions of ninety minutes each, focused on the vocabulary of retirement paperwork. Includes a printed glossary. The course is designed to improve reading comprehension, not to prepare participants to make financial decisions without professional guidance.

Reading Companion Service

Covers a two-hour in-home visit during which a trained reader reads aloud material chosen by the participant or family. The reader does not interpret legal or financial meaning, offer opinions on the content, or provide any advisory function. A written summary of material read is provided to the arranging family member after the visit.

5. Booking and Confirmation

A Service booking is confirmed when we send you a written confirmation by email. Until that confirmation is sent, no binding agreement exists. We reserve the right to decline an enquiry or booking at our discretion.

6. Fees and Payment

All fees are quoted in Thai Baht (฿) and are as stated on our website at the time of enquiry:

Payment is due in full before or at the time of the Session for the Records Indexing and Vocabulary Course. A 50% deposit is required when booking a Reading Companion visit, with the balance settled no later than 24 hours before the scheduled visit.

Accepted payment methods will be communicated at the time of booking. Fees may be updated at our discretion; any update will not affect confirmed bookings.

7. Cancellation and Rescheduling

You may cancel or reschedule a Session by contacting us in writing. The following terms apply:

If we need to cancel or reschedule a Session for operational reasons, we will provide as much notice as possible and arrange an alternative at your convenience, or refund any amounts paid in full.

8. Participant Rights During a Session

You may pause or end a Session at any time. Where a Session is ended early by you, a proportionate refund for the unused portion may be offered at our discretion. Where a Session is ended early because the participant becomes distressed or unwell, a full refund of the remaining session time will be issued.

9. Document Handling and Confidentiality

Documents handled during a Records Indexing session are treated with full confidentiality. Their content will not be recorded, transcribed, photographed, or shared by our team. Where scanning is requested, files are transferred directly to the participant's own device and no copy is retained by us.

Material read aloud during a Reading Companion visit is not recorded, summarised in detail, or retained beyond the written note of titles or subjects read, provided to the arranging family member.

10. Intellectual Property

All materials produced by Vesta Council — including the written index, printed glossary, and post-visit summary — are provided for the personal use of the participant. They may not be reproduced, distributed, or sold without our prior written consent. Course content, session structures, and training materials are proprietary to Vesta Council.

11. Disclaimers

Our Services are provided as described in these Terms. We do not make any representation that participation in a Service will produce any particular outcome. The vocabulary course is designed to support reading comprehension; it does not constitute financial education and does not prepare participants to manage financial products or make investment decisions independently.

We are not a regulated financial services provider, legal firm, or healthcare provider. Nothing communicated during any Session, in any written material we produce, or on our website constitutes professional advice in any regulated field.

12. Limitation of Liability

To the extent permitted by applicable Thai law, Vesta Council's total liability for any claim arising from a Service shall not exceed the fee paid for the specific Session giving rise to the claim. We are not liable for indirect, consequential, or incidental losses.

We are not liable for any decision made by a participant in reliance on material covered during a Session, as our Services are educational and administrative in nature only.

13. Indemnification

You agree to hold harmless and indemnify Vesta Council, its staff, and representatives from any claim, loss, or damage arising from your use of our Services in a manner inconsistent with these Terms, or from any misrepresentation you have made in connection with a booking.

14. Termination

Either party may terminate an ongoing service arrangement (such as a multi-visit reading companion schedule) by providing 14 days' written notice. Fees for Sessions delivered prior to termination remain due. Fees for Sessions not yet delivered will be refunded in full where termination is initiated by us, or in accordance with the cancellation policy where termination is initiated by the participant.

We reserve the right to terminate a service arrangement immediately where a participant or family member engages in behaviour that is threatening, abusive, or unsafe toward our staff.

15. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Thailand. Any dispute arising from or relating to these Terms or the Services provided shall first be referred to informal resolution by direct written communication between the parties. Where informal resolution is not achieved within 30 days, the dispute may be referred to a mediator agreed upon by both parties, or to the competent courts of Chiang Mai Province, Thailand.

16. General Provisions

These Terms constitute the entire agreement between you and Vesta Council in relation to the subject matter described. If any provision is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right under these Terms does not constitute a waiver of that right. These Terms may not be assigned by you without our prior written consent.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised "Last Updated" date. Where changes materially affect the terms of an existing booking, we will notify you directly. Continued use of our website or services following a change constitutes your acceptance of the revised Terms.
